Welcome to The Movement Lab 8. These Terms of Service (“Terms”) govern your access to and use of our website, services, programs, memberships, digital products, and related offerings.
By accessing our website, purchasing a service or product, enrolling in a program or membership, or participating in any training provided by The Movement Lab, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our website or purchase or participate in our services.
1. SERVICES
The Movement Lab provides fitness and movement-related services, which may include:
- Virtual training programs and coaching
- In-person personal training
- Memberships and subscription programs
- Digital workout programs, plans, guides, and other digital products
- Other fitness, movement, educational, or wellness services offered through our website
The specific services, features, pricing, duration, and requirements applicable to each program or product may be described on the applicable sales or enrollment page.
We reserve the right to modify, suspend, discontinue, or update any service, program, membership, or digital product at any time.
2. ELIGIBILITY
You must provide accurate and complete information when purchasing or enrolling in our services.
By using our services, you represent that you are legally capable of entering into a binding agreement.
If you are under the age of 18, you may participate only with the involvement and consent of a parent or legal guardian, where permitted by applicable law.
3. FITNESS AND HEALTH DISCLAIMER
The Movement Lab provides fitness and movement instruction for educational and training purposes. Our services are not medical care and are not intended to diagnose, treat, cure, or prevent any disease, injury, or medical condition.
You understand that physical exercise and fitness activities involve inherent risks, including but not limited to muscle strains, sprains, falls, injury, illness, aggravation of pre-existing conditions, and, in rare circumstances, serious injury or death.
You are responsible for determining whether participation in exercise is appropriate for you.
You should consult a qualified physician or other appropriate healthcare professional before beginning a new exercise program, particularly if you have a medical condition, injury, physical limitation, or other concern that could affect your ability to exercise safely.
You agree to follow all instructions provided by The Movement Lab and to stop exercising and seek appropriate medical attention if you experience pain, dizziness, shortness of breath, chest pain, or other concerning symptoms.
4. ASSUMPTION OF RISK AND RELEASE
By participating in any The Movement Lab service, you voluntarily assume all risks associated with participation in physical exercise and fitness activities, to the fullest extent permitted by applicable law.
You acknowledge that The Movement Lab, its owners, employees, contractors, trainers, coaches, agents, and representatives cannot guarantee that participation in any program will be free from injury or other risks.
To the fullest extent permitted by law, you agree to release and hold harmless The Movement Lab and its owners, employees, contractors, trainers, coaches, agents, and representatives from claims, liabilities, damages, losses, or expenses arising from your participation in our services, except to the extent caused by conduct that cannot legally be waived or released.
Your participation may also be subject to a separate fitness waiver or informed-consent document. If there is a conflict between that waiver and these Terms, the more specific provisions of the applicable waiver will control with respect to the subject matter of the waiver.
5. PURCHASES AND PAYMENT
You agree to provide accurate and current billing and payment information when purchasing our services or products.
By submitting payment, you authorize The Movement Lab or its designated payment processor to charge the payment method you provide for the applicable purchase price.
Prices are displayed at the time of purchase and may be changed in the future. Any price change will not affect a purchase that has already been completed unless otherwise stated.
You are responsible for any applicable taxes, fees, or charges associated with your purchase.
6. MEMBERSHIPS AND SUBSCRIPTIONS
Certain The Movement Lab services may be offered through recurring memberships or subscriptions.
Where applicable, the membership or subscription terms, billing frequency, price, and renewal information will be presented at the time of enrollment.
By enrolling in a recurring membership or subscription, you authorize recurring charges to your selected payment method according to the applicable billing schedule.
Unless otherwise required by applicable law, payments are non-refundable and memberships or subscriptions are not cancellable once purchased or billed.
We reserve the right to suspend or terminate a membership or subscription for nonpayment, violation of these Terms, misuse of our services, or other legitimate business reasons.
7. 3-Day Cancellation Right
Under New Jersey law, you may cancel a new or increased gym membership for any reason before midnight of the third operating day after you receive a copy of your membership contract.
If you cancel within this period, you are entitled to a full refund of all money paid under the contract.
Refunds will be issued within 30 days after The Movement Lab 8 receives your cancellation notice.
If you enrolled online, you may cancel online using the cancellation method provided by The Movement Lab 8.
An "operating day" is a calendar day when members may inspect and use the gym's facilities and services for at least eight hours, excluding Sundays and holidays.
Nothing in this policy limits any cancellation or refund rights provided to you under New Jersey law.
This policy applies to, without limitation:
- Virtual training programs
- In-person personal training packages
- Memberships and subscriptions
- Digital workout programs
- Other services or products purchased through The Movement Lab
By completing a purchase, you acknowledge and agree to this policy.
Nothing in this section is intended to waive or limit any refund, cancellation, chargeback, or other consumer right that cannot legally be waived under applicable law.
8. DIGITAL PRODUCTS
Digital products, including workout plans, guides, programs, videos, educational materials, and downloadable content, are licensed to you for your personal, non-commercial use.
Your purchase does not transfer ownership of the underlying intellectual property to you.
You may not:
- Copy, reproduce, or redistribute our digital products
- Resell or sublicense our programs or materials
- Share paid content with individuals who have not purchased it
- Upload or distribute our materials to third-party websites or platforms
- Modify or commercially exploit our content without written permission
Because digital products may be accessed immediately following purchase, all digital-product purchases are final and non-refundable, except where required by applicable law.
9. INTELLECTUAL PROPERTY
All content appearing on our website and within our services—including text, graphics, photographs, videos, logos, branding, workout programs, training materials, designs, and other materials—is owned by or licensed to The Movement Lab and is protected by applicable intellectual-property laws.
You may use our materials only for your personal use in connection with the services you have purchased.
You may not reproduce, distribute, modify, publicly display, sell, license, or otherwise exploit our intellectual property without our prior written consent.
10. VIRTUAL TRAINING
Virtual training may involve video calls, online platforms, messaging, recorded content, mobile applications, or other technology.
You are responsible for having an appropriate internet connection, device, exercise space, and equipment necessary to participate safely.
The Movement Lab is not responsible for interruptions caused by internet service providers, third-party platforms, equipment failures, or circumstances outside our reasonable control.
You are responsible for ensuring that your exercise environment is reasonably safe and free from hazards before beginning a workout.
11. IN-PERSON TRAINING
For in-person training, you agree to follow all reasonable instructions provided by your trainer or coach.
You are responsible for informing your trainer of any relevant physical limitations, injuries, medical conditions, or other circumstances that may affect your ability to participate safely.
The Movement Lab reserves the right to refuse or discontinue participation when we reasonably believe that continuing an activity may create an unreasonable safety risk.
12. RESULTS DISCLAIMER
We do not guarantee any particular fitness, strength, weight, appearance, performance, health, or other result from participation in our services.
Individual results vary depending on numerous factors, including consistency, nutrition, sleep, genetics, previous experience, health, lifestyle, and adherence to a program.
Any testimonials, examples, photographs, or statements regarding results are illustrative only and should not be understood as a guarantee of your individual results.
13. USER CONDUCT
You agree not to:
- Use our services for unlawful purposes
- Attempt to gain unauthorized access to our website or systems
- Copy or distribute our proprietary materials
- Share account credentials or paid content without authorization
- Interfere with the operation or security of our website
- Use our services in a manner that could harm The Movement Lab or other users
- Engage in abusive, threatening, discriminatory, or inappropriate conduct toward our staff, trainers, contractors, or other clients
We reserve the right to suspend or terminate access for violations of these Terms.
14. THIRD-PARTY SERVICES
Our website or services may use or link to third-party websites, payment processors, scheduling platforms, video platforms, software, or other services.
We are not responsible for the content, policies, availability, security, or practices of third-party services.
Your use of third-party services may be subject to those providers' separate terms and privacy policies.
15. WEBSITE AVAILABILITY
We make reasonable efforts to maintain the availability and accuracy of our website and services, but we do not guarantee that the website or any portion of our services will always be available, uninterrupted, secure, or error-free.
We may temporarily suspend website access or services for maintenance, updates, technical issues, or other reasons.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, The Movement Lab and its owners, employees, contractors, trainers, coaches, agents, affiliates, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of our website, products, or services.
To the fullest extent permitted by law, our total liability arising from your use of our services will be limited to the amount you actually paid to The Movement Lab for the specific service giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.
17. INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless The Movement Lab and its owners, employees, contractors, trainers, coaches, agents, affiliates, and representatives from claims, liabilities, damages, losses, costs, and expenses arising out of or related to:
- Your violation of these Terms
- Your misuse of our website or services
- Your violation of another person's rights
- Your participation in our services, except to the extent resulting from conduct that cannot legally be subject to indemnification
18. PRIVACY
Your use of our website and services may also be subject to our Privacy Policy.
19. GOVERNING LAW
These Terms will be governed by and interpreted in accordance with the laws of New Jersey, without regard to its conflict-of-law principles.
Any dispute arising from or relating to these Terms or your use of our services will be handled in the courts located in Essex, New Jersey, unless otherwise required by applicable law.

When we make changes, we may update the “Last Updated” date at the top of this page. Your continued use of our website or services after updated Terms become effective constitutes acceptance of the revised Terms.
